As of right now, Don has filed the motion to appeal with the 4th circuit They have acknowledged it, yet have not put it on their docket yet, so, we are in limbo Sorry, but thats where we are The House and Senate both have bills that they could consider which would help immensely with the SRNS case. However, neither legislative branch will bring them to the floor. They are playing games with peoples’ lives and livelihoods, each to make a point with the other.

Update

Federal Judge Childs ruled Friday 3rd AGAINST our request for an immediate injunction.  She has yet to rule on the SRNS motion to dismiss.  After meeting with Don and interested parties at the Barn on 12-7, we have decided, by huge majority, to proceed with the case and appeal to the 4th circuit.  As many of you know, on Tuesday the 7th, a federal judge in Georgia ruled to quash the entire mandate across the country.  What does that mean for us?  We honestly have no idea yet!  Even though SRNS is contracted by DOE, they are still a private company and can “attempt” to do what they like.  We will keep fighting this front until it is COMPLETELY over!  This is not a stand we can choose not to take, for those of us involved, and for our children.  Thank you to everyone who has and will financially support this cause!  The legal process is slow, tedious, and expensive, but our God-given freedom to determine what goes into our own bodies is worth every bit of it.  It’s sad that we are even in a place in which we have to fight this fight, but we will continue to do so with all of the passion our freedoms deserve!

Don filed several motions/rebuttals/etc. last week. The judge has put a rush on holding a preliminary hearing. The hearing will be held November 30 at 11:00 AM. It will be at the federal courthouse in Columbia. Don does not necessarily need anyone there, he’s not calling witnesses. Don does not necessarily need anyone there, he’s not calling witnesses. However, it may look good if as many of you and your friends can, go and sit behind him so the judge can see your/our presence.In the meantime, SRNS has to have something filed in response to Don’s by end of day tomorrow. So they are not going to be happy about that rush. Then Don has to have something filed by Monday, before the hearing. I’m not sure of all the legal stuff, just that both sides will be very busy for the next week.

The ways the judge could rule (keep in mind she is an Obama appointee):

*She could put an immediate temporary injunction on the mandate. (least likely)
*She could let the mandate stand and still agree to hear the case.
*She could dismiss altogether (which we would like to appeal, if we have the money)

No matter which way she rules, WE, as a community, have to make a decision as to whether to continue the suit. We have given Don $46,000 so far, but we need more to move on. The bank account is almost empty. I realize many of you have given money, not just the plaintiffs. But the suit can only go on if it can be funded. So, please pray on it, discuss it with family and friends. Contact those others who have been let go who aren’t on the suit. A positive ruling will affect them as well. A positive ruling will affect all of SC workers and possibly workers all over the country. Put out there any ideas you have for funding.
You’ve seen positive things happen in other cases across the country. Even our own 5th circuit has ruled to stop the mandate until it’s heard in court. We have a very strong case and have the potential of making a national impact.
